My son has been in jail for some time now. He recieved a 1 year prison sentence, basicly on the same offence. He would get no automatic credit for any jail time spent because there was also another reason for him to be there. If he thinks he had credit coming under a statute, he needs to appeal the sentence, beginning in the trial court and moving to higher state courts if it's denied. You have no standing to do it for him. You're not a party to it at all. He can direct his appeal to the trial court. There's no magic language. He just needs to make it clear what he thinks was done unlawfully. But if he's just asking to be credited with time while he was in there for something else, too, it's probably too late.
