I have 7 more payments on my chapter 13 bankruptcy plan and was notified that a motion to dismiss is pending. A court date is set for Jan. 18, 2011. What is this?Anyone know anything about Chapter 13 bankruptcy a motion to dismiss?You need to contact your attorney asap.
A Motion to Dismiss at this point, after you've been making regular payments for this long, is very serious. It would mean that your bankruptcy is not completed, you wpi;d not receive your discharge at the end of the payment plan, and all creditors could resume collection activities including lawsuits, foreclosures, etc.
You need to touch base with your attorney a.s.a.p. to find out what is going on -- if there is a problem to correct it --- and to file an objection to the Motion to Dismiss.Anyone know anything about Chapter 13 bankruptcy a motion to dismiss?Hard to say, but the Bankruptcy Court should be able to tell you.
